Terms of Service

These Terms of Service ("Terms") govern your use of FightEdge (the "Service"), operated by Scene Zero LLC, a Florida limited liability company ("Company," "we," "us," or "our"). By creating an account or using FightEdge, you ("User," "you," or "your") agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years of age (or the legal gambling age in your jurisdiction, whichever is higher) to use FightEdge. By creating an account, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms. If you are under 18, you may not use the Service under any circumstances.

2. Nature of the Service

FightEdge is not a sportsbook, gambling operator, or financial advisor. We do not accept bets, facilitate wagers, or process gambling transactions.

3. Responsible Gambling

Scene Zero LLC encourages responsible gambling. If you or someone you know has a gambling problem:

Never bet more than you can afford to lose. Set limits and stick to them.

4. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information during registration and to keep your email address current.

Accounts are limited to one per person. Creating multiple accounts to abuse free trials or circumvent restrictions is a violation of these Terms and grounds for immediate termination without refund.

5. Subscriptions and Payments

Free Tier: FightEdge offers a free tier with limited features. The free tier is available indefinitely at no cost.

FightEdge Pro: Premium features require an active Pro subscription billed through Stripe on a recurring basis (monthly or annual). By subscribing, you authorize Scene Zero LLC to charge your payment method on a recurring basis until you cancel.

• Free Trial: New subscribers may receive a 7-day free trial. Your payment method will be charged at the end of the trial unless you cancel beforehand.
• Cancellation: You may cancel at any time through the Stripe billing portal (accessible from your Profile page). You retain Pro access until the end of your current billing period.
• Refunds: Refund requests are handled on a case-by-case basis. Contact us via our contact form within 7 days of a charge.
• Price Changes: We may adjust pricing with 30 days' notice. Existing subscribers are notified by email before changes take effect.

Payment Processing: All payments are processed by Stripe (PCI-DSS Level 1 certified). Scene Zero LLC does not store credit card numbers or payment credentials.

6. Intellectual Property

All content on FightEdge — including but not limited to the rule + Elo predictor, isotonic calibration layer, prediction algorithms, Monte Carlo simulation engine, fight analysis narratives, reports, user interface design, graphics, and software code — is the exclusive property of Scene Zero LLC and is protected by copyright, trade secret, and other intellectual property laws.

You may not copy, reproduce, distribute, republish, scrape, or create derivative works from any FightEdge content without prior written consent from Scene Zero LLC. Sharing Pro content in a manner intended to circumvent the subscription requirement is a violation of these Terms.

7. Prohibited Conduct

You agree not to:

• Use the Service for any unlawful purpose
• Create multiple accounts to abuse free trials or promotions
• Share your account credentials with others
• Scrape, crawl, or use automated tools to extract data from FightEdge
• Redistribute, resell, or commercially exploit FightEdge content
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the Service or its infrastructure
• Use the Service if you are under 18 years of age

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Scene Zero LLC does not warrant that: (a) predictions will be accurate; (b) the Service will be uninterrupted or error-free; (c) any data provided is complete or current; or (d) use of the Service will result in financial gain.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SCENE ZERO LLC, ITS MEMBERS, MANAGERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

SCENE ZERO LLC'S TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM YOUR USE OF FIGHTEDGE SHALL NOT EXCEED THE AMOUNT YOU PAID TO SCENE ZERO LLC IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR FIFTY DOLLARS ($50.00), WHICHEVER IS GREATER.

10. Assumption of Risk

You acknowledge that sports betting involves substantial risk of financial loss. You assume full responsibility for any wagers you place based on information obtained through FightEdge. Scene Zero LLC shall have no liability for any gambling losses you incur, regardless of whether such losses relate to information provided on the Service.

11. Indemnification

You agree to indemnify, defend, and hold harmless Scene Zero LLC, its members, managers, employees, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law; or (d) any gambling activity undertaken by you.

12. Binding Arbitration

The arbitration shall take place in the State of Florida. The arbitrator's award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

Small claims exception: Either party may bring an individual action in small claims court for disputes within the court's jurisdictional limits.

Opt-out: You may opt out of this arbitration provision by sending written notice to Scene Zero LLC via our contact form within 30 days of creating your account. If you opt out, disputes will be resolved in accordance with Section 14 (Governing Law).

13. Class Action Waiver

YOU AND SCENE ZERO LLC AGREE THAT EACH PARTY MAY BRING DISPUTES ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. The arbitrator may not consolidate more than one person's claims and may not preside over any form of class or representative proceeding.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any legal action not subject to arbitration shall be brought exclusively in the state or federal courts located in the State of Florida, and you consent to the personal jurisdiction of such courts.

15. Termination

We may suspend or terminate your account and access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately. Sections 6, 8, 9, 10, 11, 12, 13, and 14 shall survive termination.

16. Trademark Notice

FightEdge is not affiliated with, endorsed by, or sponsored by UFC, Zuffa LLC, or any of its subsidiaries. UFC and the UFC logo are registered trademarks of Zuffa LLC. All UFC fighter names, likenesses, and event names are used for informational purposes under nominative fair use.

17. Changes to Terms

We may update these Terms at any time. Material changes will be communicated by email at least 14 days before they take effect. Your continued use of FightEdge after the effective date constitutes acceptance of the revised Terms.

18. Severability

If any provision of these Terms is held to be invalid or unenforceable, that provision shall be modified to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

19. Entire Agreement

These Terms, together with the Privacy Policy and Disclaimer, constitute the entire agreement between you and Scene Zero LLC regarding your use of FightEdge.

20. California Consumer Privacy Act (CCPA)

If you are a California resident, you have the right to:

• Know what personal information we collect and how it is used
• Delete your personal information (via your Profile page or by contacting us)
• Opt-out of the sale of personal information — we do not sell your personal data to third parties
• Non-discrimination — we will not discriminate against you for exercising your CCPA rights

To exercise these rights, use the account deletion feature on your Profile page or contact us via the Contact form.

21. European Data Protection (GDPR)

If you are located in the European Economic Area (EEA) or United Kingdom, you have additional rights under the General Data Protection Regulation:

• Right to Access — request a copy of your personal data
• Right to Rectification — correct inaccurate personal data
• Right to Erasure — request deletion of your personal data
• Right to Restriction — request we limit processing of your data
• Right to Portability — receive your data in a structured, machine-readable format
• Right to Object — object to processing based on legitimate interests

We process your data based on (a) your consent (account creation), (b) performance of a contract (subscription services), and (c) legitimate interests (security, fraud prevention, service improvement).

To exercise any GDPR rights, contact us via the Contact form. We will respond within 30 days as required by law.

22. Geographic Restrictions & Gambling Compliance

FightEdge is an informational and entertainment platform — not a sportsbook. We do not accept, place, or facilitate any wagers. However, users are responsible for compliance with local laws regarding sports prediction services and sports betting in their jurisdiction.

If sports betting prediction services are restricted in your jurisdiction, you should not use FightEdge Pro features. We reserve the right to restrict access from jurisdictions where our service may conflict with local regulations.

23. Force Majeure

Scene Zero LLC shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to: natural disasters, acts of government, internet outages, cloud infrastructure failures, third-party API disruptions (including but not limited to The Odds API, UFC data sources, Stripe, and AWS), pandemics, or labor disputes.

24. Data Breach Notification

In the event of a data breach that affects your personal information, we will notify affected users via email within 72 hours of becoming aware of the breach, as required by applicable law. We will also notify relevant regulatory authorities as required.

25. Service Modifications

We reserve the right to modify, suspend, or discontinue any feature or aspect of FightEdge at any time, with or without notice. We will make reasonable efforts to notify Pro subscribers of material changes that affect their subscription. Continued use of the service after modifications constitutes acceptance of the updated service.
